Representative Jared Moskowitz (D-Fla.) has openly criticized the International Criminal Court (ICC) branding it as politically influenced and insignificant. He suggests the ICC has failed to uphold its mandate effectively due to this political bias.
Moskowitz drew attention to the alleged bias of the ICC towards Israel. He questioned the lack of investigation into charges made against China and Syria. The representative argued that these perceived bias undermine the ICC’s credibility and highlighted the need for the ICC to deter conflict and deliver justice.
In highlighting the ICCs lack of authority in certain countries, Moskowitz questioned why significant global powers such as the United States, Russia, and China, have not ratified the Rome Statute. He called for comprehensive reform to enable the court to prosecute those guilty of grave crimes against humanity.
Moskowitz also criticized the ICC’s absence of authority over Israel, questioning the global pressure that could potentially undermine Israel’s autonomy. He stated that these threats to Israel’s independence highlight the court’s lack of influence.
The ICC’s recent initiative to obtain arrest warrants for high-ranking Israeli and Hamas officials has sparked backlash. This has led to bipartisan consensus in Congress to penalize the ICC for perceived controversial actions.
Moskowitz demands changes in ICC’s practices
The United States government has since sanctioned numerous ICC officials, arguing that its approach was unjust and politically motivated. However, proponents of the ICC argue that these criticisms are attempts to undermine the court’s mandate to uphold justice.
President Biden and progressive Democrats have also expressed disapproval of the ICC’s actions, deeming them as “outrageous”. Moskowitz noted that refusal by the United States and Israel to support the ICC’s treaty leaves the court with limited capacity to press charges against individuals from these countries implicated in alleged offenses. However, he states the ICC can still conduct investigations and influence other international jurisdictions. This lack of support from the US and Israel undermines the ICC’s authority and credibility, presenting a significant challenge for achieving global justice.
Finally, Moskowitz wished for a bipartisan resolution from the United States on this issue, advocating for legislative action. He emphasized the need for both parties in Congress to take prompt action and implement relevant laws to navigate this issue effectively.
